Kitui County Assembly Speaker Hon. Kevin Kinengo Katisya on Wednesday dismissed two petitions seeking the removal of key finance officials, citing failure to meet the legal and procedural thresholds required by law.
During a plenary session, the Speaker addressed two separate petitions: one targeting County Executive Committee Member (CECM) for Finance, Economic Planning, and Revenue Management, Mr. Peter Mwikya Kilonzo, and another seeking a motion of censure against Chief Officer for Finance and Revenue, Mr. John Makau Kimwele.
The petitions, dated April 29 and May 6, 2025, had alleged gross misconduct, constitutional violations, abuse of office, misappropriation of public funds, and obstruction of oversight, among other claims.
Speaker Kinengo clarified that after review by the Clerk of the Assembly, the petitions failed to satisfy the procedural requirements as set out under Article 37 of the Constitution and Section 15 of the County Governments Act, 2012.
“The petitions in their current form do not meet the legal and procedural threshold required for consideration by the Assembly,” Speaker Kinengo stated, adding that they would only be admissible if amended to align with applicable laws and standing orders.
The Speaker further emphasized that the County Assembly lacks the legal mandate to discipline or remove a Chief Officer from office, stating, “The Assembly does not have the authority to discipline or remove a Chief Officer from office.”
The development underscores the importance of adhering to constitutional and statutory provisions in seeking accountability in county governance.
